The Attorney General is seeking a highly motivated attorney to join his Medicaid Fraud Control and Patient Abuse Unit (MFCU) as a Special Assistant Attorney General to handle complex criminal and civil enforcement actions related to allegations of fraud against the state Medicaid program and allegations of abuse and neglect of residents of long-term care facilities.

Assistant and Special Assistant Attorneys General represent the people of Rhode Island in civil and criminal matters before trial courts, appellate courts, and the supreme courts of Rhode Island and the United States. The Office is unique among attorneys general offices across the country. Out of fifty states, only two other offices share the same broad criminal mission. The Office’s attorneys prosecute complex and violent crimes but also functionally serve as one of the nation’s largest district attorney’s offices, prosecuting all felonies throughout the state.

About the Unit: The mission of the Medicaid Fraud Control Unit (MFCU) for the State of Rhode Island is to investigate and prosecute fraud in the administration of the Medicaid program in Rhode Island, in the provision of medical assistance, or in the activities of providers of medical assistance pursuant to the Medicaid Program. Further, the MFCU seeks to protect residents or patients in health care facilities by investigating and prosecuting allegations of abuse and neglect.

A Special Assistant Attorney General in the MFCU reports to the Director of the MFCU and is responsible for tasks as assigned by the Director in the course of the MFCU’s pursuit of its mission. A SAAG in the MFCU assists and directs Attorney General Investigators and other MFCU personnel during investigations, reviews completed investigations, conducts legal research, and prepares, files, presents and litigates MFCU cases in court. The activities of a MFCU SAAG also include, but are not limited to, participation in multi-jurisdictional and multi-disciplinary task forces, collaboration with the MFCU’s state and federal partners and participation in outreach efforts related to the MFCU’s mission.

Primary Duties: MFCU Special Assistant Attorneys General manage a caseload of complex civil and criminal matters with responsibilities including: partnering with federal, state and administrative agencies to investigate allegations of fraud against the state Medicaid program and allegations of abuse, neglect, and misappropriation of funds occurring in long-term care facilities; drafting administrative demands, civil investigative demands, drafting complaints for civil cases and criminal cases, taking and defending depositions, taking civil investigative demand oral testimony; handling pretrial motions and discovery; drafting legal memoranda on motions to dismiss, motions to suppress, motions in limine and summary judgment motions, conducting settlement and plea negotiations, and conducting bench and jury trials in both civil and criminal courts.

Requirements: 

Position Requirements: The successful candidate will have least three to six years of civil litigation experience, be self-motivated, and possess the ability to exercise good judgment and decision making while working within a collaborative team structure. Background and experience in complex civil litigation, health care fraud litigation, and False Claims Act litigation involving pharmaceuticals, medical devices, and Medicare/Medicaid providers is preferred.
