Today President Joe Biden released his FY2021 budget, and it includes a number of proposals that would, if passed by the U.S. House of Representatives and Senate, meaningfully improve access to justice in the United States.
NLADA welcomes the President’s requests for $600 million for the Legal Services Corporation (LSC), an increase of $135 million. This would be the largest increase in recent years to enable grantee organizations to aid many thousands more Americans. However, it would only begin to address the historical underfunding of civil legal aid, the consequences of which have been made plain by the COVID-19 pandemic.

Mr. Floyd’s death sparked a renewed racial reckoning in our nation. The external and introspective conversations around racial inequities occurring within many institutions are critical to producing necessary change; but we must do more. The continued loss of Black lives from the use of excessive force by law enforcement officers must end. The disparities perpetuated by systemic racism must be eliminated.

The National Legal Aid and Defender Association (NLADA) welcomes the recent announcements by the White House and the Department of Justice on access to justice. The Presidential Memorandum on Restoring the Department of Justice’s Access-to-Justice Function and Reinvigorating the White House Legal Aid Interagency Roundtable and accompanying Attorney General Memorandum on Access to Justice recognize the indispensable role of civil legal aid and public defense in upholding the rule of law and the fair administration of justice. They also establish important actions that will greatly enhance the ability of the federal government to improve access to justice for people across the United States.

Justice Cruz Reynoso was a champion of justice in and out of the robe. As the first Chicano California State Supreme Court Justice, he served as a role model and inspiration for young Latinos across the nation. Throughout his career, he never forgot his roots as a child of migrant workers who himself worked in the fields of California.

We remain mindful, however, of the black and brown lives that continue to be lost disproportionately due to excessive force by law enforcement, and of the countless black and brown families who are still waiting for justice.

NLADA joins with our community of public defenders, civil legal aid providers and client advocates in strongly denouncing the increase of violence and hate crimes against persons of Asian and Pacific Islander (AAPI) ancestry. There is no place in America for racial discrimination or hate crimes, and we will work in partnership with directly impacted communities to eradicate these evils.
These violent incidents and the initial tepid response to them illustrate the proliferation of hate being driven by implicit and explicit bias and the spread of false information and narratives intended to legitimize racism. We all must raise our voice against this hate.
