Job Description:
Under the supervision of an Assistant Chief Counsel, the attorney in this position is responsible for independently providing written and oral legal advice to CARB's executives, management, and staff on complex legal issues, many of them relating to California's climate change program. The position will focus on developing, implementing, and enforcing regulations, including regulations related to climate change programs. These assignments may include legal support for the climate change program, direct air emissions control requirements, and related programs.

The attorney in this position will work closely with CARB staff, and as needed officials from other federal and State government agencies, on all phases of the development and implementation of complex and technical regulations and programs implementing the state’s climate change and air quality programs. This work includes developing and drafting regulations and overseeing rulemaking material preparation to ensure regulations can withstand any subsequent legal challenges in both federal and State courts. Key functions of this position include: legal advice on requirements of the California Environmental Quality Act and Administrative Procedure Act; review of staff reports, letters, guidance and other documents for potential legal issues; coordinating with federal and State agencies on issues relating to interpretation of statutory and regulatory provisions and program implementation; and legal assistance to support Board actions. The attorney in this position will draft and review legal correspondence, provide CARB staff and the Chief Counsel with written and oral advice, and will perform a variety of other legal-related tasks.

Desirable Qualifications:
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
Candidates should have a desire to advance the underlying objectives of CARB to protect and enhance California's air quality and address climate change. Candidates should have the ability to work with high-level government officials, as well as experience dealing with members of the public, technical staff, and other public agencies, and should be familiar with the functioning of administrative agencies in State government.
Among other qualities, the most highly desirable candidates will have:
1. Extensive background or in-depth knowledge of the federal and State laws governing greenhouse gases, other environmental laws (e.g., California Environmental Quality Act), administrative law, and constitutional law).
2. Excellent writing skills.
3. Demonstrated capacity to analyze issues arising under federal, State, and local laws and effectively provide clear recommendations on complex multidisciplinary issues.
4. Ability to work quickly and effectively under pressure to identify issues, develop solutions, and produce products within a short timeframe.
5. Demonstrated capacity to communicate clearly, effectively, and professionally -- both orally and in writing -- to technical, lay, and policy-oriented audiences.
6. Demonstrated capacity to work cooperatively with a team and work independently to complete work assignments.
